CONDITIONS OF SALE

CONDITIONS OF SALE:

To buy at auction, it is essential that you bring an identity document with you, as well as a cheque which will be used as a deposit, or at least €500 paid in cash or by debit card per vehicle auctioned.
Payment for vehicles (auction cost plus sales fees and additional charges)must in all cases be made within a maximum of 4 days after the sale. Beyond this deadline, you will be charged holding fees of €10 incl. VAT. Any vehicle not paid for 8 days after the sale will be put back on sale as part of the “unsound bid” resale with the resulting financial and legal consequences for the defaulting purchaser.

MECHANICAL WARRANTY:

It is essential that this is taken out and activated on the day of the sale from the warranty representative in attendance.
A free 3-month mechanical warranty is offered to the purchaser under the warranty provider’s conditions for vehicles indicated by a sticker at the exhibition. It covers the following elements: lubricated moving parts of the engine, gear box and axle; electric circuit, electronic modules and electronic injection and air-conditioning systems. This warranty includes road assistance in France and the EU.
You have the option of extending the warranty to 6 or 12 months by contacting the warranty provider present on the days of the exhibition, sale and after-sale.

INSURANCE AND PERSONAL LIABILITY:

Obligation to take out personal liability insurance.
Option of subscribing on the spot to personal liability insurance for between 24 hours and 15 days before taking your vehicle(s) away from our premises. The auction company and the auctioneering are free of any liability in the event of failure by the purchaser to secure personal liability insurance.

PURCHASER FEES:

11.994 % incl. VAT on top of the auction fee (for most vehicles)
Between 8% and 18% incl. VAT for certain categories: always refer to the information panel on the vehicle

PURCHASER FEES FOR LEGAL SALES:

Legal sale: 14.352 %

IN BOTH CASES, COMPULSORY OR VOLUNTARY INSPECTIONS ARE TO BE ADDED. THESE ELEMENTS ARE SPECIFIED ON THE INFORMATION PANEL ON EACH VEHICLE.

PAYMENT BY CHEQUE:

On the day of the sale, as soon as the auction has ended, you must provide a deposit cheque made out to the auction company. When taking the vehicle away, you must provide us with a bank cheque, to replace the deposit cheque, corresponding to the exact amount of the auction selling price plus charges.

PAYMENT IN CASH:

Commercial traders, under the terms of Article L 112-6 of the French Monetary and Financial Code, may not use cash to pay for any sum over €750.
Payment in cash is limited to a total of €3000, including fees, for all purchases made by a single person at a single auction. This applies to vehicles remaining in France. For vehicles intended for export, payment in cash is limited to a total of €7600, including fees, for all purchases made by a single person at a single auction. Payment must be made by bank cheque or Swift transfer for any purchase up to €7600, including fees.
The property reservation clause will remain effective until the day on which payment has been received for the auctioned vehicle.
For all cash purchases, a deposit instalment of at least €500 will be requested per vehicle bought.

HANDOVER:

Vehicles will be released against a bank cheque, a bank lodgement, a bank guarantee or a validated Swift transfer, checked by us, and with the purchaser being required to pay for all purchases made at the same sale. To this payment will be added, where applicable, holding fees of €10 incl. VAT per day and per vehicle not collected within 4 working days.
Vehicles are handed over on the days and opening hours of the centres.

EXPORT:

IF THE VEHICLE SOLD IS TO BE EXPORTED TO ANOTHER COUNTRY OUTSIDE THE EUROPEAN UNION, the buyer must indicate this as soon as the vehicle has been sold to him. It is essential that the buyer is a foreign resident not domiciled in France.

If the buyer assigns the auction company to carry out the export formalities via a forwarding agent, who is responsible for paying the fees, the auction price and purchaser fees including VAT have the VAT amount at 19.60% deducted.
If the buyer does not assign the auction company to carry out the export formalities, he must pay the VAT amount, which will be cashed by the auction company, as a security deposit, when the latter gives him the sale slip.
This VAT amount will be returned to the buyer when the latter has sent section no. 3 of the DAU export document to the auction company, duly stamped by Customs on front and back, and on which the address details of the auction company are given in the “exporter – dispatcher” field, within a maximum deadline of one month from the auction sale.
If this document is not returned within the required deadline, the VAT amount will be returned to the buyer.

IF THE VEHICLE SOLD IS TO BE SENT TO ANOTHER COUNTRY IN THE EUROPEAN UNION, the VAT regime differs depending on whether or not the buyer has a VAT number in another European Union country.

If the buyer has a VAT number in another European Union country and assigns transportation of the vehicle to the auction company, notifying it of the contact details for the transporter chosen by him at his expense, the auction price and purchaser fees including VAT will have the VAT amount at the rate of 19.60% deducted.

If the buyer has a VAT number in another European Union country but does not assign transportation of the vehicle to the auction company, he must pay the VAT amount, which will be cashed by the auction company, as a security deposit, when the latter gives him the sale slip.

This VAT amount will be returned to the buyer when the latter has sent the following documents to the auction company within one month of the date of the auction sale:

  • a copy of the “CMR” road transportation document duly signed by both transporter and buyer, as well as a copy of the transportation invoice,
  • or, a copy of the vehicle registration card from the other EU country.

If the vehicle sold is intended to be sent to another country in the European Union and the purchaser does not have a VAT number in another country in the European Union, the auction price and the purchaser fees will include VAT.

The auction company rejects all responsibility for the legal or fiscal consequences of a false declaration by the purchaser.

RECOVERABLE VAT:

For vehicles for which VAT is recoverable, the possibility of recovery is stated on the information panel attached to the windscreen, on the sale list, and is announced by the accredited auctioneer at the sale.

GENERAL CONDITIONS:

The auction company acts as agent for the owner of the vehicle put up for sale, and in no way as owner of this vehicle. It is the responsibility of the would-be purchaser to check all the technical information specified on the information panel attached to the windscreen of the vehicle during its exhibition prior to sale. The sale by auction is recorded in the sale records taken. It is irrevocable and cannot under any circumstances be cancelled a posteriori, for any reason whatsoever brought up by the seller.  
Information given on the sale list is provided by way of reference only and without guarantee.
The dates and years of first road registration do not under any circumstances guarantee the year of the vehicle and are not binding in any way whatsoever on the auctioneer or the auction company.
Only the technical inspection or preliminary inspection displayed on the windscreen during the exhibition and the sale, and the announcement made at the time of auctioning the vehicle and included in the sale records will have legal status.
The Argus rate displayed or announced is given by way of reference only and without guarantee, and it is up to the purchaser to check it.  All equipment and options are given by way of reference only without verification of their operational condition. The vehicle order numbers may be changed without notification. The administrative documents required for re-registration of the auctioned vehicle may be given to the purchaser immediately after payment or sent within a maximum deadline of 30 days.
Buyers having acquired several vehicles during a single sale cannot take away part of their purchases before full payment of the overall amount owed. The daily holding fees will concern all purchases made.

BUYING ORDER:

If you are interested in a vehicle but you cannot attend the sale, give us a buying order! we will place the bids on your behalf at the time of the sale. To do so, simply fill in the form provided for this purpose and available from the reception on the day of the exhibition, accompanied by a security deposit cheque and a copy of an identity document.

UNPAID VEHICLES:

After eight days, lots which have not been paid for will be presented at an “unsound bid” resale at the next auction session, following notification to the purchaser by registered, recorded letter.

The difference between the initial auction (purchaser fees included) and the sale price gained at the unsound bid resale will remain payable by the defaulting purchaser. The purchaser fees paid at the time of the initial sale are definitively retained by the Sales Centre or the auctioneer
